Terms of Service

Marketgent is a web application that drafts, schedules, and publishes content to social media accounts you have connected, on your behalf and under your control. Every publish step requires either explicit human approval or a standing approval rule that you have configured. The service is provided “as is” on a beta basis — we do our best to keep it running but we offer no uptime guarantee.

You must be at least sixteen years old to use Marketgent. You are responsible for any activity on your account, for keeping your sign-in credentials confidential, and for promptly notifying us if you suspect unauthorised use.

You must provide accurate information during onboarding and keep it up to date. Operating multiple accounts to evade limits or bans is prohibited.

You retain all rights to the brand information you supply and to every draft Marketgent generates on your behalf. By using the service you grant us a limited licence to store, process, and transmit that content for the sole purpose of running the service for you.

When the agent publishes a draft, your content travels through the social platform’s API under your own connected account and is governed by that platform’s terms.

You may not use Marketgent to:

• Publish content that infringes intellectual property, defames any person, harasses, or incites violence.
• Spam, manipulate platform engagement metrics, impersonate third parties, or violate the terms of the social platforms you have connected.
• Distribute malware, attempt to circumvent rate limits, probe the service for vulnerabilities without permission, or scrape its content.
• Resell or repackage the service as your own without an explicit written agreement.
• Use the service for any unlawful purpose or in violation of any applicable export controls or sanctions regimes.

We may suspend or terminate an account that we reasonably believe is violating these rules, with or without notice depending on severity.

You authorise Marketgent to publish on the social accounts you connect, for as long as those connections remain active. You can revoke a connection at any time from the dashboard or from the social platform’s own settings.

We are not responsible for the actions of the social platforms themselves, including any takedowns, suspensions, shadow-bans, or API changes that affect the agent’s ability to publish.

Pricing for paid plans is shown on the pricing section of the site at the time of purchase. Subscriptions renew automatically until cancelled. You may cancel at any time; cancellation takes effect at the end of the current billing period and we do not refund unused time, except where a statutory right of refund applies.

Marketgent generates content. Nothing it produces is legal, financial, medical, or other professional advice. You are responsible for reviewing every draft before approving it for publication and for ensuring it complies with the laws and platform rules that apply to you.

To the maximum extent permitted by law, the service is provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the maximum extent permitted by law, Marketgent will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenue, whether incurred directly or indirectly. Our aggregate liability for any claim arising out of or relating to the service is limited to the greater of (a) the fees you paid us in the twelve months preceding the claim, or (b) one hundred US dollars.

You agree to indemnify and hold Marketgent harmless from any claim, demand, loss, or expense (including reasonable legal fees) arising out of content you publish through the service, your violation of these terms, or your violation of any third-party rights.

You may stop using Marketgent at any time. We may terminate your access for material breach of these terms or if we cease offering the service. On termination, your right to use the service ends; provisions of these terms that by their nature should survive will survive (including indemnity, warranty disclaimer, and limitation of liability).

We may revise these terms from time to time. Material changes will be announced via email or on this page at least seven days before they take effect. Continued use of the service after that effective date constitutes acceptance of the revised terms.

These terms are governed by the laws of India, without regard to its conflict-of-laws principles. Any dispute will be resolved in the courts of Mumbai, India, except where local consumer-protection law gives you the right to bring the dispute in your own jurisdiction.
